PLDT DSL TERMS AND CONDITIONS

CONSENT AND AGREEMENT 

PLDT may revise the terms and conditions regarding this Service from time to time by posting amended/revised revisions of this document on the PLDT DSL website. The subscriber hereby expressly agrees to be bound to any amendment or revision to this document duly posted on the PLDT DSL website. Accordingly, users of PLDT DSL services should consult this website regularly to ensure that their activities conform to the most recent version of the subscriber agreement. In the event of a conflict between any subscriber agreement and this document, the terms of the posted subscriber agreement will govern. Queries or complaints regarding this document can be directed to mydsl@pldt.com.ph

FEES, RATES AND CHARGES 

The Subscriber agrees to pay the DSL service charges to PLDT according to his selected payment plan in the PLDT myDSL Application Form. PLDT reserves the right to increase the monthly subscription fees and impose charges other than indicated in the said form.

ACCESS TECHNOLOGY

PLDT reserves the right to select which access technology to use for the Subscriber’s broadband internet access. The Subscriber shall not be allowed to choose the technology, and agrees to pay any additional fees required by the technology type selected. PLDT shall also not be held liable for any technological limitations the selected technology may impose on the Subscriber’s Service.

BILLING AND PAYMENT 

a) Billing - PLDT shall forward to the subscriber a services rendered. Notwithstanding the non-delivery or late delivery of the said SA, the Subscriber can request, at any reasonable time, information as to his outstanding balance through PLDT's Customer Service Hotline (171). 

b) Payment - The Subscriber shall pay or pre-pay his service charges and fees for nay balance left on or before the due date in the SA. PLDT shall inform the Subscriber of his regular due date in each succeeding SA. Notwithstanding the non-delivery or late delivery of any SA, it shall be the responsibility of the Subscriber to inform himself of his Outstanding Balance through the Customer Service Hotline and effect immediate payment, without need of further demand, on or before the regular due date. Payments may be jade at any of PLDT's offices, through duly authorized banks, or to its duly authorized collectors. PLDT shall not be liable for any payment made to persons other than its authorized representatives. 

c) Charge in Billing Address - The Subscriber shall inform PLDT in writing of any changes in his billing address. PLDT shall not be responsible for the consequences of the Subscriber's inability to receive his SA and pay his dues on time as a result of his failure to timely notify PLDT of any change in billing address. 

d) Non-payment - If the subscriber fails to pay within 30 days after the invoice date, delinquency charges amounting to 1.0% per month of the outstanding balance shall be imposed. PLDT may temporarily or permanently disconnect the services of any Subscriber for failure to pay the accounts. Such disconnection shall be without prejudice to any action available to PLDT under other portions of this Agreement, under the law or in equity in order to recover all amounts and damage/s suffered by PLDT for such non-payment, if any. 

e) Reconnection - Reconnection will require full payment of the outstanding balance plus the corresponding charges for late payment, plus an applicable reconnection fee of P300 if the service was suspended with 6 mos. or P1,500 for over 6 mos. 

f) VAT and Other Charges for Service Provided - In addition to the installation fee and the monthly billing, the subscriber must pay the government - mandated value-added tax (VAT) equivalent to the 10% of the costs of all services provided. 

LEASED EQUIPMENT 

a) Leased equipment, including DSL modems and converters, installed at the premises of the Subscriber shall remain the property of PLDT. Subscriber shall take proper care of the equipment, shall not remove the equipment from the place of connection by PLDT and will not make any modifications, alterations or addition to the equipment. 
b) Damage to Leased Equipment. The Subscriber shall be liable to PLDT for any loss or damage to leased equipment installed and received in good order. 
c) Return of Leased Equipment. The leased equipment installed in the premises of the Subscriber shall be pulled-out and returned to PLDT upon termination of this Agreement without need of demand. 

NON-TRANSFERABILITY OF THIS AGREEMENT 

This Service Agreement may not be leased, assigned or transferred by the Subscriber without prior written consent by PLDT. The cables including connections and other accessories shall remain the property of PLDT Subscriber shall have no property right or interest over the same but only the right to use them under this agreement. 

DISCLAIMER AND LIMITATION OF LIABILITY 

While this Agreement is in effect, PLDT will not assume any liability for any suits, actions and/or claims arising from any and all damages, prejudice or losses claimed by or against the Subscriber, including any damage to property including, but not limited to, the Telephone sets, DSL Modems or Personal Computer or the house of the Subscriber or third person, injury to persons that may be caused by lightning, typhoon, earthquake, or other natural calamities or acts beyond the control of PLDT. 
Notwithstanding anything contained herein to the contrary, any liability of PLDT in connection or arising out of this Agreement shall be limited to the most recent one month fee actually paid by the Subscriber to PLDT. 

VENUE OF ACTIONS 

The parties agree that the venue of all actions arising from this Agreement shall be the court of proper jurisdiction of Makati City, Metro Manila, Philippines. 

ACCESS TO PREMISES 

The Subscriber shall allow access to Subscriber's premises the duly authorized personnel of PLDT for maintenance and inspection purposes. 

ILLEGAL ACTIVITY 

The use of the Services for any activity that is contrary to morals and public policy or which violates any ordinance, law, decree, order or regulation shall be a violation of the terms and conditions of this agreement which shall entitle PLDT to disconnect the DSL service and claim for damages incurred by PLDT in the occasion thereof. 

BANDWITH, DATA STORAGE AND OTHER LIMITATIONS 

The Subscriber must comply with the current bandwidth, data storage and other limitations of the PLDT DSL Services. 
Users must ensure that their activity does not improperly restrict, inhibit, or degrade any other user's use of the Services nor represent (in PLDT's sole discretion) an unusually large burden on the network itself. In addition, users must ensure that their activity does not improperly restrict, inhibit, disrupt, degrade or impede PLDT's ability to deliver and monitor the Services, backbone, network nodes, and/or other network services. 
PLDT network residential customers shall not resell,, share, or otherwise distribute the Services or any portion thereof to any third party without the written consent of PLDT (i.e. the Subscriber cannot provide Internet access to others through a dial up connection, host shall accounts over the Internet, provide email or news service, or send a news feed). 
The PLDT residential service offering is a consumer product designed for subscriber's exclusive and personal use of the Internet only. The residential service does not provide the type of security, upstream performance and total downstream throughout capability typically associated with commercial use. 
The Subscriber shall not run a server in connection with the PLDT residential service, nor shall the Subscriber provide network services to others via the PLDT residential service. The PLDT residential service includes personal Webspace accounts for publishing personal Web pages. Examples of prohibited uses include, but are not limited to, running servers for mail, http, ftp, irc, and dhcp, and multi-user interactive forums. 

SERVICE COMMITMENT, ADDITIONAL CHARGES AND PROPERTY RIGHTS 

a) Additional Installation Charges. There will be additional charges for material and labor for installations in excess of 150 feet from top part to the Subscriber's premises. 
b) Service Commitment. The fee due to PLDT shall continue to accrue without deductions even in case of service interruption. Due to the nature of internet, PLDT does not warrant fast internet access to be available at all times. However, PLDT shall exert its best efforts to ensure continuous fast DSL internet at the premises of the Subscriber. 
c) PLDT reserves the right to adjust, modify, amend or supplement these terms and conditions as the service may require. 
d) PLDT owns the property rights and interest in the Services and all that is attached to the system. The Subscriber, hereby, undertakes to uphold the property rights and interest of PLDT and hereby binds himself/itself to refrain from taping, recording, duplicating or otherwise reproducing, in any manner and form whatsoever and for any purposes, the programs, trademarks/logo, copyrights and services received by and passed to him/it under and by reason of this Agreement. A breach of this provision shall result to the termination of this Agreement without prejudice to PLDT's rights to recover damages and to file any court action. 

VIOLATION OF ACCEPTABLE USE POLICY 

PLDT does not routinely monitor the activity of accounts for violation of this Policy. However, in PLDT's efforts to promote good citizenship within the Internet community, PLDT will respond appropriately in the event that it becomes aware of inappropriate use of its Services. PLDT and its various affiliates and partners reserve the right to monitor bandwidth, usage and content from time to time to operate the Services to identify violations of this Policy, and/or to protect the network and PLDT users. 
PLDT shall advise Customers/Subscriberss of inappropriate behavior and any necessary corrective action. However, if the Services are used in a way which PLDT or its distribution affiliates, in their sole discretion, believe violate this Policy, PLDT or its affiliates may take any responsive action they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal content, cancellation of newsgroup posts, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. Neither PLDT nor its distribution affiliates will have any liability for any such responsive actions. The above described actions are not PLDT's exclusive remedies and PLDT may take any other legal or technical action it deems appropriate under the circumstances. 
PLDT reserves the right to investigate suspected violations of this Policy, including the gathering of information from the user or users involved and the complaining party, if any, and examination of material on PLDT's servers and network. During an investigation, PLDT may suspend the Subscriber hereby authorizes PLDT and its distribution affiliates to cooperate with (i) law investigation authorities in the investigation of suspected criminal violations, and (ii) system administrators at other internet service providers or other network or computing facilities in order to enforce this Policy. Such operation may include PLDT providing the username, IP address, or other identifying information about a Subscriber. Upon termination of an account, PLDT is authorized to delete any files, programs, data and email messages associated with such account. 
The failure of PLDT or its distribution affiliates to enforce this Policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time. The Subscriber agrees that, if any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect. This Policy shall be exclusively governed by, and construed in accordance with, the laws of the Republic of the Philippines. 

NO RESALE OR COMMERCIAL USE OF THE SERVICE 

Subscriber's right to use the Service is personal to the subscriber. Whether a Subscriber is an individual or a corporation or any other business entity, the Subscriber agrees not to resell or to make any commercial use of the PLDT DSL Service, without the express written consent of PLDT. If a Subscriber is found guilty of reselling the service, his/its subscription will immediately be terminated without requiring any prior notice to the Subscriber.
